Purpose

The purpose of these general terms and conditions is to define the rights and obligations of the parties in the context of the online sale of goods offered by THE SELLER to the consumer.

Order confirmation

The contractual information will be confirmed by email to the address provided by the consumer on the order form.

Proof of transaction

Computerized records, kept in the computer systems of THE SELLER under reasonable security conditions, are considered as proof of communications, orders, and payments made between the parties. The archiving of order forms and invoices is carried out on a reliable and durable medium that can be produced as evidence.

Price validity period

Our prices are valid for the day.

Product information

All efforts have been made to ensure the accuracy of the information presented on THE SELLER'S WEBSITE. THE SELLER or its suppliers are however not responsible for the consequences, incidents, or special damages resulting from electronic transmissions or the accuracy of information transmitted, even in the event that THE SELLER was aware of the possibility of such damage. Product and manufacturer names and trademarks are used for identification purposes only. Product photographs, descriptions, and prices are not contractually binding.

Delivery methods

Products are delivered to the address provided by the consumer on the order form and only within the geographical areas we serve. All products leave our premises in perfect condition. They travel at the customer's risk (damage or loss). The customer must notify the carrier (or postal worker) of the slightest sign of impact (holes, tears, crushing marks, etc.) on the parcel, and if necessary refuse the parcel. An identical new product may be resent to you with or without additional charges. The exchange of any product declared, after the fact, to have been damaged in transit, without any reservation having been made upon receipt of the parcel, cannot be accepted. As with any shipment, a delay or loss of the product is possible. In such a case, we will contact the carrier to initiate an investigation. All efforts will be made, for as long as necessary, to locate the parcel. We disclaim all liability for extended delivery times caused by the carrier, particularly in the event of loss of products, bad weather, or strikes.

Delivery problems caused by the carrier

Any anomaly relating to the delivery (damage, missing item compared to the delivery note, damaged parcel, broken or torn products, etc.) must be noted without fail on the delivery note in the form of "handwritten reservations", accompanied by the customer's signature. The consumer must simultaneously confirm this anomaly by sending the carrier, within (2) two working days following the delivery date, a registered letter with acknowledgement of receipt setting out said claims. The consumer must forward a copy of this letter to the SELLER'S ADDRESS. 

Delivery errors

The consumer must notify the SELLER, on the day of delivery or at the latest on the first working day following delivery, of any claim of delivery error and/or non-conformity of products in nature or quality compared to the details shown on the order form. Beyond this period, any claim will be rejected. This claim may be submitted to the SELLER at the SELLER'S ADDRESS. Any claim not made in accordance with the rules defined above and within the allotted time frame cannot be taken into account and will release THE SELLER from all liability towards the consumer. In the event of a delivery error or exchange, any product to be exchanged or refunded must be returned to the SELLER in its entirety and in its original packaging in impeccable condition to the SELLER'S ADDRESS. To be accepted, any return must be notified and have the prior agreement of the SELLER, who, if agreed, will resend the parcel to the correct address. In the event of an exchange or return, the costs of return and new dispatch shall be borne by the consumer.

In the event of loss of the return parcel by the carrier, addressing error, and therefore non-receipt of the return parcel by us, no refund will be issued. We advise you to return your parcels via Colissimo and not by standard mail.

Product warranty

The provisions herein cannot deprive the consumer of the statutory warranty that obliges the professional SELLER to guarantee them against all consequences of hidden defects in the item sold.

Right of withdrawal

The right of withdrawal applies only to natural persons (private individuals).

In accordance with Articles L. 221-18 et seq. of the French Consumer Code, you have a period of fourteen (14) days from the day after receipt of the last product in your order to exercise your right of withdrawal without having to justify any reason or pay any penalty. Any return may be notified in advance to the SELLER's customer service. The product must be returned to the SELLER'S ADDRESS. Products must not have been unsealed or opened in order for the consumer to benefit from the right of withdrawal. Only products returned in their entirety, in their complete and intact original packaging, and in perfect resalable condition will be accepted. Any product that has been damaged, or whose original packaging has been deteriorated, will neither be refunded, nor accepted for return, nor exchanged. This right of withdrawal is exercised without penalty, with the exception of shipping and return costs, packaging costs, and PayPal or financial charges. In the event that the right of withdrawal is exercised, the consumer may choose either a refund of the amounts paid or an exchange of the product. In the case of an exchange, reshipping costs shall be borne by the consumer. If the right of withdrawal is exercised, the SELLER will make every effort to reimburse the consumer within thirty days.

Force majeure

Neither party shall have failed in its contractual obligations to the extent that their performance is delayed, hindered, or prevented by an act of God or force majeure. Any fact or circumstance that is irresistible, external to the parties, unforeseeable, unavoidable, independent of the parties' will, and which cannot be prevented by them despite all reasonably possible efforts, shall be considered a force majeure event. The party affected by such circumstances shall notify the other within ten working days from the date on which it became aware of them. The two parties shall then come together, within a period of three months, unless prevented by the force majeure event, to examine the impact of the event and agree on the conditions under which the performance of the contract will be continued. If the force majeure event lasts longer than one month, these general terms and conditions may be terminated by the aggrieved party. Expressly considered as force majeure events or acts of God, in addition to those usually recognized by the case law of French courts and tribunals: blockage of means of transport, earthquake, fire, storms, flood, lightning, shutdown of telecommunications networks, or difficulties specific to telecommunications networks external to customers.

Partial invalidity

If one or more provisions of these general terms and conditions are held to be invalid or declared as such in application of a law, a regulation, or following a final decision by a competent court, the remaining provisions shall retain their full force and effect.

Non-waiver

The failure of either party to invoke a breach by the other party of any of the obligations referred to under these general terms and conditions of sale shall not be construed as a waiver of the obligation in question for the future.

Applicable law

These general terms and conditions are governed by French law, both as regards substantive and procedural rules. In the event of a dispute or complaint, the consumer shall contact the SELLER in the first instance to seek an amicable resolution.

Personal data protection

All data you entrust to us is used solely for the purpose of processing your orders. Pursuant to French Law No. 78-17 of 6 January 1978 relating to data processing, files, and civil liberties, you have the right with the SELLER to rectify, consult, modify, and delete the data you have provided to us. This right may also be exercised online. This website is registered with the CNIL under number 2025227.

Disputes

Any order placed through the SELLER'S WEBSITE entails the customer's acceptance, without any restriction, of the SELLER's general terms and conditions of sale. In the case of a sale to a legal entity, any dispute relating to the sale (price, general terms and conditions, products, etc.) shall be subject to French law before the Commercial Court of the SELLER's registered office.
